The Fair Housing Act
The Fair Housing Act, enacted in 1968 and amended in 1988, prohibits discrimination in the sale, rental, and financing of dwellings based on the following protected classes:
Protected Classes
- Race
- Color
- Religion
- National Origin
- Sex (including sexual harassment)
- Disability (physical or mental)
- Familial Status (families with children)
Note: Some states and localities provide additional protections beyond the federal Fair Housing Act, including protections based on sexual orientation, gender identity, source of income, and other characteristics.
Prohibited Discriminatory Practices
Under the Fair Housing Act, it is illegal to:
- Refuse to rent or sell housing
- Refuse to negotiate for housing
- Make housing unavailable
- Deny a dwelling
- Set different terms, conditions, or privileges for sale or rental
- Provide different housing services or facilities
- Falsely deny that housing is available for inspection, sale, or rental
- Engage in blockbusting (persuading owners to sell or rent based on protected class entry)
- Deny anyone access to or membership in a facility or service related to the sale or rental of housing
- Threaten, coerce, intimidate, or interfere with anyone exercising fair housing rights
Advertising and Marketing
All advertising and marketing materials must comply with fair housing laws. We do not:
- Use discriminatory language or imagery in property listings
- Express preference, limitation, or discrimination based on protected classes
- Target advertising to exclude protected classes
- Use selective marketing techniques that discriminate
Reasonable Accommodations and Modifications
For Persons with Disabilities
Under the Fair Housing Act, housing providers must:
- Reasonable Accommodations: Make exceptions to rules, policies, practices, or services when necessary to provide equal housing opportunities (e.g., allowing a service animal in a “no pets” building)
- Reasonable Modifications: Allow tenants to make reasonable modifications to their dwelling or common areas at their expense (e.g., installing grab bars, widening doorways)
Familial Status Protections
It is illegal to discriminate against families with children under age 18, including:
- Refusing to rent to families with children
- Imposing different terms or conditions on families with children
- Advertising housing as “adults only” (except qualified senior housing)

- Treat all clients and customers with equal respect and professionalism
- Show all available properties without discrimination
- Provide the same information and assistance to all prospective buyers and renters
- Refrain from steering clients toward or away from specific neighborhoods
- Maintain confidentiality regarding protected class information
- Follow all fair housing laws and ethical standards
Filing a Fair Housing Complaint
If you believe you have experienced discrimination in a housing transaction, you have the right to file a complaint with:

Timeline: Complaints must be filed within one year of the alleged discrimination
You may also file a complaint with your state or local fair housing agency, or file a lawsuit in federal or state court within two years of the alleged discrimination.
